The situation regarding unauthorised arrivals in Australia, their detention, their possible application for asylum and the determination of such applications against the United Nations 1951 Convention and the 1967 Protocol relating to the Status of Refugees and against Australian law is a complex process.

Australia is taking a consistent position which provides protection to those persons who are assessed as engaging our obligations and ensures that all claims are properly considered while meeting our responsibilities to maintain the integrity of Australia’s borders and migration programs.
